Terms of Service

1. Who we are

smartimoti ("smartimoti", "we", "us") operates a real-estate search and marketing platform for the Bulgarian property market, available at smartimoti.com (the "Service"). By creating an account or using the Service you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What the Service does

The Service aggregates publicly available property listings from Bulgarian property portals, removes duplicates, and provides search, alerting, analytics and AI-assisted tools on top of that data. It also provides marketing tools ("Smart Advertising") that help property sellers and agencies draft and publish promotional content for their own listings to third-party platforms such as Facebook, Instagram, Google, YouTube and TikTok.

3. Accounts

  • You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account.
  • You must be at least 18 years old and legally able to enter into contracts.
  • We may suspend or terminate accounts that violate these terms, abuse the Service, or attempt to disrupt it.

4. Credits and payments

  • Premium features are billed through a credit system. Credits are purchased as one-off packs or granted by a subscription plan; payments are processed by Stripe. We do not store your card details.
  • Credits are deducted when a paid action starts. Credits consumed by a completed action are not refunded. Unused purchased credits do not expire; subscription allowance credits reset with each billing period.
  • Prices and credit costs are shown in the app before each paid action and may change with notice.

5. Connected third-party accounts

  • Smart Advertising lets you connect your own accounts on third-party platforms (e.g. Facebook, Google, YouTube, TikTok) via each platform's official authorisation flow. We only receive the permissions you approve, and you can revoke them at any time from the Service or from the platform's own settings.
  • Content is published to those platforms only when you explicitly trigger publishing (or schedule it yourself). You are the publisher of that content and are responsible for its accuracy and for complying with each platform's rules and advertising policies.
  • Your use of each third-party platform remains governed by that platform's own terms of service.

6. Listing data and AI output

  • Listing information is aggregated from third-party portals and is provided "as is". We work to deduplicate and refresh it, but we do not guarantee that any listing is accurate, current, or still available, and we are not a party to any property transaction.
  • AI-generated content (post text, translations, summaries, images, price estimates and similar) is produced by automated models and may contain errors. Review it before relying on it or publishing it. It is not legal, financial or investment advice.

7. Acceptable use

  • No scraping, bulk-downloading or reselling of the Service's data without our written consent.
  • No uploading of unlawful, misleading or infringing content, and no use of the marketing tools for spam or deceptive advertising.
  • No attempts to bypass usage limits, security controls or billing.

8. Intellectual property

The Service, its software, design and branding are owned by smartimoti. You keep all rights to content you upload (photos, videos, descriptions) and grant us a licence to host and process it solely to operate the Service — including transmitting it to platforms you ask us to publish to.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, smartimoti is not liable for indirect or consequential damages, lost profits, or losses arising from property transactions, third-party platform decisions (including ad account restrictions), or inaccuracies in aggregated data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these terms. Sections 6–9 survive termination.

11. Changes

We may update these terms as the Service evolves. Material changes will be announced in the app or by email; continued use after the effective date constitutes acceptance.

12. Governing law and contact

These terms are governed by the laws of the Republic of Bulgaria, and disputes fall under the jurisdiction of the competent courts in Sofia. Questions: hello@smartimoti.com.
